Few facts that you need to get clear.
1) EB2 / EB3 is not based solely on your education/ experience. It depends on job requirements. If you have MS + 10 Yrs exp but the job is say Level 2 Data Analyst (SQL Developer) then it will not qualify for EB2.
2) You can file GC with same employer if he has a opening that requires MS qualification. You need to have qualification before labor is filed it does not matter if you get it while you were employed. This position should be different from your existing job.
If your employer has a job opening for which he cannot hire a citizen / GC holder then you guys can talk to immigration attorney to see if they can file a new labor for you.

I need your input.
My PD was Feb 2006-EB2.
I changed job on June 22nd to another company using EAD. Now the PD has become current for Aug.My old company and the new company are in different cities but it is the same state.
I was planning to apply for AC-21 but i have not gotten consistent pay checks yet. My first check was a partial check. I will have 2 consistent paychecks by Aug 15th.
1) Is it safe to just wait and see if i get a 485 approval without alerting USCIS about my job change?
I am thinking since the job change is very recent they might not know about this job change.
2) If they denied my 485 application for any reason ,can i continue to work while i apply for "reconsidering my 485 application" and file AC-21 with the new company?
Please advice what you think about this. Basically i am trying to "not rock the boat" and raise suspicion and more RFEs by notifying them about this very recent change.

hi,
what i heard from my new employer is that it is not advisible to invoke Ac21 as long as you get RFE from where you have filed your 485 application or through attroney,
they told me that if you invoke AC21 it may delay your process. so what i feel is that it is better not to invoke AC21 as long as previous employer is in good terms with you....

I'm trying to figure out the reasoning behind Mexico's numbers as well. According to the latest cut-off date tables http://www.travel.state.gov/pdf/EmploymentDemandUsedForCutOffDates.pdf
Mexico has about 5,800 folks total for EB-3 in the queue so far, but we have seen very little movement in the past years. My questions to the forum:

An I-140 has nothing to do with I-485, except to the extent that an I-140 has to be approved before an I-485 can be approved. So I-140 approval is must before an I-485 can be approved. Further, an I-140 is not related to the priority date - An I-140 can be filed any time once one has an approved labor (Assuming, of course, one is applying in EB2/EB3). But I-485 can only be picked up for processing (or even filed) if the priority date is current.
If your I-485 date is not current, it does not matter what you do about your I-140. The question about affecting I-485 is irrelevant if your priority date is not current, which is the situation now.

I did my three years diploma (polytechnic) and three years engineering degree (B.E.) after that and I had @ eight years of experience while I had applied for GC through EB2 category. I had no problem in getting my I-140 approval; so far I have not received single rfe.

I will start another thread regarding that, however. I want to ask about enforcing referential integrity and self-incrementing unique id's.

yes it looks like a boiler plate RFE. you will just need to be cautious with the information you are giving to RFE and Make sure it is consistent with what ever you provided earlier.
Also, get your collegues/managers from previous company to give you letters stating that you worked with him/her for that company during the stated period. Like explained above get as much consisten evidences liek w2's pay stubbs for that period. For the Ability to pay , have your company get with the CPA and prepare those statements.

Can people convert LC pending in BEC to PERM? If So, how safe it is and how much time it takes totally.

the BEC uses old generous rules to process applications. thus chances of success are better
perm is faster and thus you can get 140 done sooner to get 3 year extension instead of 1 year.
you can transfer priority date via perm. however if your case in perm is denied, you get into problem. you cannot then go back to BEC application.
bec should process cases by mid next year. there is lot of pressure on them. till now their performance has not been all that good and they are getting lot of flak for it.
in the current retrogression scenario, even if you get perm and 140 approved, you will still be in the back of the line at 485.

On 2nd July, what time was your i-485 application received at NSC?

My application reached NSC on july 2nd 10.25 am & the LUD on my I-140 was changed on July 28th still no receipt notice or the cheque got cashed. No idea whatz going????
So I guess the LUD change is nothing relevant to I-485 filing.

Hello,
I called USCIS Boston Field office today ( 800 # on the FP Notices ) and the Customer Service Rep told me that If we have already given finger prints then we can ignore the second FP notices. But she did not ask for any of our A# or Receipt #. I asked her to pull out my record based on 485 receipt # and verify if the finger prints we gave earlier are correct and we do not have to worry about the second finger prints notices. She said she cannot do that.
SO, I got Infopass appointment for tomorrow. If at all, the officer says tomorrow that I do not have to worry about the second FP notices then what should I do ???
1) Do they send any kind of letter in mail saying I should ignore the second set of FP notices. ( OR )
2) Should I ask for any thing in writing saying that we are good with the finger prints we already gave and do not have to worry about the new notices (OR)
3) Do they put any stamps and write on our new FP original notices saying Finger Prints not required for the second time.
Thank you for letting me know.
If they can endorse in any form on your notice (or other wise give any paper), it will be good for future. Otherwise I have heard that they just tend to say that ignore notice.
In any case keep the record of your visit.

Does anyone have recent experience with the Chicago office of Consulate of India for passport renewal. How long does it take? 2 weeks, 3 weeks, more than 3 weeks.
I went there in 2005 for renewing my friends passport. UPS lost his passport and VISA in transit. We were very pleased with the process.
We went to the office in downtown, reached at about 9 am. They were pretty quick to take the required documents and within 1 hr everything was done and we left the place.
Came back at 3:30 pm to collect the passport. Visa was stamped correctly. They made us wait for 1.5 hrs and called our name. We took the passport and drove back.
Let me know if you have any questions.
